November 2, 2025 update: Your voice is needed at the Ontario Land Tribunal (OLT). Landowners Lux 387 M.D. Holdings Inc et al have appealed City Council’s denial to the Provincial Tribunal. The proposal for "Rosewood - Estate Homes on Oversized Lots" by Elite Developments is to build 17 low density luxury houses on oversized estate lots resulting in regrading of the lot and the loss of virtually all of the lot's 632 mature trees including 56 'Heritage Trees' many of which could be over a century old. Three types of species at risk bats, Butternuts, a Common Hoptree, an American Chestnut and a significant amount of other wildlife are also present. If you sent a letter to City Council in April, feel free to repurpose it as an OLT statement. Letters sent are here if you need inspiration for your comments.

The proposal for "Rosewood - Estate Homes on Oversized Lots" by Elite Developments is to build 17 low density luxury houses on oversized estate lots, a sound wall and berm to the north, a retaining wall to the south, and a stormwater pond. Braithwaite Ave will also be extended to Hamilton Drive. All of this will result in regrading of the lot and the loss of virtually all of the lot's 632 mature trees including 56 'Heritage Trees' many of which could be over a century old. Three types of species at risk bats, Butternuts, a Common Hoptree, an American Chestnut and loads of other wildlife are also present.

This property is entirely within a Significant Woodlot which is listed on Hamilton's Official Plan Natural Heritage System map as a Core Area. Core Areas are protected... but...there is also a Secondary Plan for this area which designates this property as "low density residential" meaning development is permitted because Secondary Plans trump (sorry) the Official Plan. The zoning also permits development.
Join us in asking the Planning Committee to:
1. Vote against the loss of 632 mature trees to build 17 'estate homes on oversized lots' with no consideration of the housing crisis and housing affordability, Hamilton's Urban Forest Strategy or the out of date Ministry letter concerning the species at risk.
2. Vote to direct staff to update this secondary plan and zoning in order to proactively protect several remaining unprotected sections of this woodlot and the wetland west of Tollgate Drive from further development.
